Welcome to Pixit Labs Private Limited (“Pixit Labs”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our mobile applications, websites, and related services (collectively, the “Service”). By accessing or using the Service, you agree to comply with these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please refrain from using the Service.

1. Acceptance of Terms

• By using the Service, you affirm that you are of legal age to form a binding contract in your jurisdiction or have obtained parental consent if required
• We reserve the right to modify these Terms at any time. Continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Service Description

Pixit Labs Private Limited develops and publishes applications and services, including but not limited to mobile apps, websites, and virtual reality experiences. The Service is intended for personal, non-commercial use unless otherwise specified.

3. User Accounts

• Certain features of the Service may require registration. You agree to provide accurate, current, and complete information during the registration process and to update such information to maintain its accuracy.
• You are responsible for safeguarding your account credentials and agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

• Some features of the Service may require a subscription or in-app purchases. By subscribing, you agree to pay the applicable fees as presented at the time of purchase.
• Subscription fees may be billed through third-party platforms such as the Apple App Store, Google Play Store, or Amazon Appstore. You are subject to their terms and conditions in addition to these Terms.
• Subscription renewals are automatic unless canceled in accordance with the third-party platform’s cancellation policy.

5. Intellectual Property

• All content provided through the Service, including software, graphics, text, and trademarks, is the property of Pixit Labs Private Limited or its licensors and is protected by copyright and intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. Unauthorized use of the content is prohibited.

6. Privacy and Data Collection

• Our Privacy Policy outlines the types of information we collect, how we use it, and how we protect your privacy. By using the Service, you consent to the practices described in the Privacy Policy.
• We may collect non-personal information such as device identifiers, usage data, and location information to improve the Service and provide personalized experiences.

7. User Conduct

You agree not to:

• Engage in any activity that disrupts or interferes with the Service.
• Use the Service for any unlawful or prohibited purpose.
• Attempt to gain unauthorized access to any part of the Service or related systems.

8. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

9. Disclaimers and Limitation of Liability

• The Service is provided “as is” without warranties of any kind, either express or implied.
• To the maximum extent permitted by law, Pixit Labs Private Limited shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the Service.

10. Indemnification

You agree to indemnify and hold harmless Pixit Labs Private Limited and its affiliates from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

11. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the Republic of India.
• Any disputes will be resolved through binding arbitration in Chennai, Tamil Nadu, India, under the Arbitration and Conciliation Act, 1996, and subject to the exclusive jurisdiction of the courts of Tamil Nadu, India.

12. Additional Terms for Apple App Store Users

This section applies to any application you obtain from Apple’s App Store (a “Licensed Application”) and to your use of it on any Apple-branded device, including iPhone, iPad, Mac, Apple TV, Apple Watch, and Apple Vision Pro.

• Standard EULA. Licensed Applications are licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms apply in addition to the Standard EULA; if they conflict with respect to your license to use a Licensed Application, the Standard EULA controls.
• Apple’s Role. These Terms are between you and Pixit Labs Private Limited only, and not with Apple Inc. (“Apple”). Pixit Labs Private Limited, not Apple, is solely responsible for the Licensed Application, its content, and any maintenance and support for it.
• Purchases and Subscriptions. In-app purchases and subscriptions made in a Licensed Application are processed by Apple and charged to your Apple Account at confirmation of purchase. Auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, and your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel subscriptions in your Apple Account settings. Refund requests for App Store purchases are handled by Apple under its policies; we are unable to issue refunds for purchases made through the App Store.

13. Miscellaneous

• If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
• These Terms, together with our Privacy Policy and, where applicable, the Standard EULA, constitute the entire agreement between you and Pixit Labs Private Limited regarding the use of the Service.
